TERMS OF USE OF THE SERVICES

INTRODUCTION: KEY DEFINITIONS AND WHAT MAKES UP YOUR TERMS OF USE

The following definitions are used in these terms and conditions:
"Bonus Terms" means any terms and conditions and/or rules with regard to promotions, bonuses and special offers which may apply to any part of the Services from time to time
"Your Contact Details" are as defined in paragraph 4
"Download Terms" means any additional end user terms and conditions of use which You are required to confirm Your agreement to as part of the download and/or installation of any software which You may download in order to be able to use the Website, including the Playtech End User Licence Agreement which can be found in the Appendix of these General Terms
"General Terms" means the terms and conditions set out in this document "Group" means in relation to any party, a company which is from time to time a subsidiary or the ultimate holding company of that party or another direct or indirect subsidiary of any such ultimate holding company. "Privacy Policy" means Lucayan Lottery privacy policy accessed via the Privacy Policy link
"Rules" means the Betting Rules and the Game Rules specifically applicable to the relevant type of betting and/or gaming, as identified in more detail in paragraph 1.3.1 and 1.3.2
"Services" means, as appropriate, the services offered for the time being by Lucayan Lottery through the Website and/or via any mobile or tablet application.
"Terms of Use" means (a) the General Terms, (b) the Privacy Policy and (c) where appropriate under paragraph 1.3, the relevant Rules, Bonus Terms and Additional Terms applicable to the Services that are being used by You and (d) any Download Terms
"Website" means the website https://lucayanlottery.com or any page or section thereof for the time being affiliated with "LucayanLottery.com", via link Authorize.net By using and/or visiting any section of the Website, or by opening an account with Lucayan Lottery through the Website, You agree to be bound by the Terms of Use and You accordingly: (a) agree to the use of electronic communications in order to enter into contracts; and (b) waive any applicable rights or requirements which require a signature by hand, to the extent permitted by any applicable law. The Terms of Use do not affect your statutory rights.
In addition, when you play any fixed odd game, or place a bet using the Services, or otherwise use the Service, You agree to be bound by: the Rules For All Sports Bets on Lucayan Lottery Sports Book as set out by the Sports book operator; and
The Rules of any game you play ("Game Rules"), are set out under the relevant game tab help tab. In respect of any new games, the rules applicable to such game; any Bonus Terms; any Download Terms; and any other terms applicable to the Services and/or which you are required to confirm your agreement to as part of the Services are clearly stated in each game application. The terms of use of this site is written in English and any interpretation of the said terms will be based on the original English text. If the terms of use or any documents or notices related to them are translated into any other language, the original English version will prevail. In the event that there is any specific conflict or inconsistency between any of the individual parts of the terms of use making that form your contract with Lucayan Lottery, the order of precedence shall be as follows:
• the Bonus Terms;
• the Betting Rules;
• the Game Rules;
• the Additional Terms;
• the General Terms;
• the Privacy Policy; and
• the Download Terms.
Please read the terms of use carefully before accepting them. Once You have accepted the terms of use, please print the terms of use and store them, along with all confirmation emails, additional terms, transaction data, game rules, fair deal rules and payment methods relevant to Your use of the Website. Please note that the terms of use are subject to change, as set out in paragraph 3 below. If You do not agree to accept and be bound by the Terms of Use refrain from opening an account, and/or continue to use your Account. Your continued use of any of the Services will constitute acceptance of the Terms of Use which you have notified of and which are in force from time to time as the company deems necessary. The terms of use govern the contractual agreement between you and Lucayan Lottery. All terms are deemed in affect for the date of commencement. For the avoidance of doubt, each and all sections of the Website are governed by the Terms of Use, please note that any use of service provided by Lucayan Lottery is governed.

GENERAL TERMS
Terms of Use The Terms of use shall be agreed between You and Lucayan Lottery whose gaming activity is regulated under fixed odd betting licence 2016-17 issued by the Betting Authority of Bermuda. The Website, the odds and prices contained therein are translated into a number of languages and are therefore intended to be used by the citizens of the relevant countries and other countries which speak those languages. References in the Terms of Use to "us", "our" or "we" are references to: Lucayan Lottery; or In the case of terms and conditions relating to monies held in Your Account from time to time, Lucayan Lottery hold such funds on trust for the user and such terms (where appropriate) are deemed to include the Lucayan Lottery’s agents, partners, and suppliers.
CHANGES TO THE TERMS OF USE These Terms of use, from time to time, will be altered for a number of reasons, including (without limitation) for commercial reasons, to ensure compliance with any applicable law or regulations, to comply with instructions, guidance or recommendations made by a regulatory body, and/or for customer reasons related to customer service. The Terms of use can be accessed 24 hrs a day and will be updated from time to time as Lucayan Lottery deems necessary. Notice will be given to all users of any substantial changes to the Terms of use. For minor or insubstantial changes, we may not give You any notice of such changes, so You are advised to review the Terms of use through the on a regular basis. Changes to the Terms of use will be communicated to the user by any such method of notification as we may, in our discretion, deem to be appropriate, which may comprise of the following methods: Email (email address provided by user); Message to account user inbox ; or Written notice on the Website. At the discretion of the company we may from time to time invite You to accept the any new term of use by selecting "yes" or "I accept", by checking a 'tick box' or any other similar method of confirmation by You. If You provide us with any such confirmation, or continue to use the Website or after notification under this paragraph 3, You shall be deemed to have accepted, and be bound by, the new Terms, including (for the avoidance of doubt) any additions, removals, substitutions or other changes to the identities of Lucayan Lottery, whether or not You have read the revised Terms of Use. If any change is unacceptable to You, You may either cease using the Services and/or close Your Account by complying with paragraph 12 of these General Terms. OPENING YOUR ACCOUNT In order to place a bet or play a game using the Services, You are required to open an account with Lucayan Lottery know as ("Your account" or "Account"). In order to open Your Account for use with the Services, You may apply online. Your Account is operated by Lucayan Lottery on your behalf. All transactions will be monitored and reviewed from time to time to ensure accuracy of gaming patterns. At the time of submitting your application you will be required to provide Lucayan Lottery with personal information, two forms of identification, your name, date of birth, contact details, including an address, telephone number and e-mail address that can be immediately validated. Your Contact Details are required to be updated from time to time by contacting Customer Service through the My account management page on the Website or by such other method as that shall deemed appropriate by Lucayan Lottery. In opening Your Account you warrant that: You understand and accept the ALL risks associated, by using the Services, You may, as well as winning money, lose money; You are (a) over 18 years of age and (b) above the age at which gambling or gaming activities are legal under the law or jurisdiction that applies to you (the "Relevant Age"); Gambling is not illegal in the territory where you reside; You are legally able to enter into contracts; At no time have not been excluded and or banned from use of any from gambling; and You have not previously held an account that was closed pursuant by Lucayan Lottery for Collusion, Cheating, Fraud and/or Criminal Activity, or any Breach of the Terms of use. Further as a result of our request under due to requirements supported by Responsible Gaming/Gambling. All accounts must be registered in your own, correct, name and personal details and shall only be issued once. No account is permitted to be duplicated and/or assigned to any other person, family, household, address (postal or IP), email address, or any environment where computers are shared (e.g. schools, workplaces, public libraries etc), computer (or other access device), and/or account in respect of the Services. Any other accounts which you open with Lucayan Lottery, or which are beneficially owned by you in relation to the Services shall be "Duplicate Accounts". We may close any Duplicate Account (but shall not be obliged to do so). If we close a Duplicate Account: All bonus rewards, free bets and winnings accrued from such bonuses and free bets obtained using that Duplicate Account will be void and forfeited by you; We may, at our entire discretion, void all winnings and refund all deposits (less amounts in respect of void winnings) made in respect of that Duplicate Account and, to the extent not recovered by us from the relevant Duplicate Account, any amounts to be refunded to us by You in respect of a Duplicate Account may be recovered by Lucayan Lottery directly from any other of Account associated with you (including any other Duplicate Account); or We may, at our entire discretion, allow usage of the Duplicate Account to be deemed valid in which case all losses and stakes placed by or for you through the Duplicate Account shall be retained by us.
VERIFICATION OF YOUR IDENTITY; MONEY LAUNDERING REQUIREMENTS You warrant that: The name, address, identification address supplied when opening an Account are correct and true; and further The rightful owner of the funds deposited, which you at any time may deposit into your Account. By agreeing to the Terms of use you authorise Lucayan Lottery to verify any information provided from time to time as we may deem necessary or may be required by third parties (including, but not limited to, regulatory bodies). It is agreed that from time to time, upon our request, you may be required to provide additional details in respect of any such information you have provided to Lucayan Lottery, including any deposits that may be questioned, which were made to your account. Your account may be in review for monitoring from time to time. On those occasions your account may be restricted from withdrawing funds and/or accessing the entire website or parts of the website. If any such restrictions cause you a problem, please contact Customer Services. We may have the need to contact you, so that we may be provided with certified copies of your identification. Identification may be in the following form: notarised ID or any equivalent certified ID issued by your jurisdiction, proof of address, utility bills, bank details, bank statements and bank references. Until such information has been supplied to our satisfaction we may prevent any activity on your account. Where we reasonably believe that you have deliberately provided incorrect information, your account will be immediately closed and Lucayan Lottery will keep any amount deposited on the account at the time of closure. All users must be 18 years or older unless the user resides in a jurisdiction that recognizes another age for its age of majority. If we are unable to confirm that you are the relevant age then we may suspend your account until such time as your age can be verified. If you are proven to have been under the relevant age for gaming. Your Account will be closed; All transactions made whilst you were underage will be made void, and all related funds deposited by you will be returned by the payment method used for the deposit of such funds, wherever practicable; Any deposits made while you were under the relevant age will be returned to you; and Any winnings which you have accrued less any winnings derived prior to the discovery of misfeasance.
ACCOUNT, PIN and CUSTOMER INFORMATION Upon account activation Lucayan Lottery will supply you with a temporary pin to access your account. We advise you to take all reasonable steps to avoid disclosing (whether deliberately or unintentionally) your account credentials, e.g. PIN and/or account number, to any other individuals. Please also ensure that your computing device is equipped with updated security software, to ensure maximum protection of your account personal information. All transactions made by your account via your pin and account number will be deemed valid, whether or not you conducted the transaction. Lucayan Lottery will not be liable for any claims in the event your account, pin or account number is disclosed or obtained by another person (whether deliberately or unintentionally). If You have lost or forgotten your account number and/or pin, or you have reason to believe that such details are known to an unauthorized third party, please Contact Customer Services immediately to report the issue. Customers must keep their PIN and login ID secure. Customers are responsible to change PIN regularly not less than once every six months and/or when the system prompts a request for you to change your pin.
DEPOSITS AND WITHDRAWALS FROM YOUR ACCOUNT If you wish to make any fixed odd bet via the website, you are required to capitalize your account in-store or via the website. Such funds may be used to place any authorized bet or play games any fixed odd game offered by Lucayan Lottery via any third party concession. Further details of how to deposit, withdraw and transfer funds can be found in the Deposit page of the Help section of the Website. If you use a payment method that does not bare your credentials, we reserve the right to treat that deposit as being invalid (and any winnings arising from such deposit as void) pending the satisfactory completion of all relevant Checks. All real money deposits must be wagered 1 time before a withdrawal can be made. Eg. If you deposit $20 you must make $20 worth of wagers before a withdrawal can be requested. Lucayan Lottery reserves the right to charge a 10% fee in case the player requests a withdrawal without a member account turnover that is equal or more than the amount of funds deposited. Upon requesting a withdrawal all active bonuses and any winnings accrued from bonus funds or promotions will be removed from your account You further agree not to make any charge-backs, reversals or otherwise cancel any deposits into your Account, and in any such event to refund and compensate Lucayan Lottery for such unpaid deposits including any expenses incurred by us in the process of collecting your deposit. For the avoidance of doubt your Account shall not be used by you as a bank account and, should we become aware of frequent deposits and withdrawals from your Account without commensurate betting or gaming activity, we reserve the right to deduct an administration charge (whether or not we close or suspend the account). Your Account is not a bank account and is therefore not insured, guaranteed, sponsored or otherwise protected by any deposit or banking insurance system or by any other similar insurance system. Any monies deposited with us in your Account shall not attract any interest. Monies deposited with us are held on trust like a normal bank account and/or escrow account in the name of Lucayan Lottery or another subsidiary of Axum Limited company, which holds the monies in the account on trust for you and other persons entitled. As such, in the event of our insolvency, you would be entitled to claim any monies held on trust for you in such an account, but your funds are not protected under any statutory deposit guarantee scheme. We may at any time set off any positive balance on your Account against any amount owed by you (including under a duplicate account) to any other company within Axum Limited (irrespective of whether there has been a breach of the Terms of Use), including (without limitation) where we re-settle any bets or wagers pursuant to duplicate accounts, Collusion, Cheating, Fraud and Criminal Activity or Errors and/or Commissions. To the extent required by your local tax requirements or other government authorities you are solely responsible for reporting your winnings and losses arising from your gaming activities on Lucayan Lottery. You have the ability to set a deposit limits on your account day to day. This limit cannot be increased without giving twenty-four hours' notice of your intended change. Any such request to alter you limit will take effect (24) twenty-four hours after your request is made. For details of how to set up a deposit limit please contact Customer Services, or via the website by clicking on My Account and selecting update my account. Any confirmed reductions to your deposit limit will be amended with immediate effect. When closing your account you may request a 100% withdrawal of funds from your account at any time provided that: All payments made into Your Account have been confirmed as cleared and no charge backs being reviewed, reversed or otherwise cancelled; Any Checks referred to in paragraph 5 above have been completed by us to our satisfaction; and You have complied with any other relevant withdrawal conditions affecting Your Account (e.g. any applicable Bonus Terms). The minimum amount of any single payout is 25 Euro/GBP/USD/BD/BMD. On any withdrawal approved by us, provided that You give us sufficient information as to how the funds should be transferred to You, we will return the relevant funds to you less any charges or fees incurred or any other amount required to be deducted from the funds being withdrawn in order to comply with your withdrawal request. We will attempt to accommodate any such request regarding the payment method and currency of payment of your withdrawal. This, however, cannot be guaranteed. Therefore, we may process and pay withdrawals in a different manner than the one requested. Payment may take the form of wire transfer; direct deposit, ATM withdrawal and or Bank Draft. Any charges associated with relevant payment methods are set out in the withdrawal tab of the website. Similarly, in certain cases, the currency of your withdrawal may not be the currency in which your deposit was made or that was otherwise requested by you and, in circumstances where we are required to convert your deposits between different currencies, the conversion rate used may differ and/or vary from time to time. We are required to hold monies in the deposit account and/or escrow account as trustee for you and not as your banker or debtor. Therefore, notwithstanding any other provision in the Terms of Use, we will hold your money as a trustee, and no such provision shall create or give rise to any obligation on the part of Lucayan Lottery (or any other Axum Limited company) to repay money to you as your debtor.
IN-ACTIVE ACCOUNT FEE If your Account lies dormant for a period of 180 consecutive days where no betting or gaming, deposit, withdrawal or transfer has taken place. Your account will be rendered in active. All Inactive Accounts will incur an Inactive account fee, the details of which can be found in the Help section of the website. We will notify you when Your Account becomes Inactive. We will within 14 days prior to charging any Inactive Account Fee advise you of the deduction. Maximum winnings per week via the Lucayan Lottery.com are $25,000 or a currency equivalent to that sum. Unless specifically authorized by us in writing, Player may only withdraw $10,000 from his/her Account in any 30 day period.
LEGAL USE OF THE WEBSITE Access to or use of the website or any of the gaming services via the website may not be legal for some or all residents of certain countries. We do not intend that the website should be used for betting, gaming or any other wagering activity by persons in countries in which such activities are illegal, which includes the United States of America and those territories listed via the Help tab on the website. The fact that the website is accessible in any such country, or appears in the official language of any such country shall not be construed as a representation or warranty with respect to the legality or otherwise use of the gaming services offered on the website, and/or the making of deposits or receipt of any winnings from the account. The availability of the website does not constitute an offer, solicitation or invitation by us for the use of or subscription to betting, gaming or other services in any jurisdiction in which such activities are prohibited by law. It is your responsibility to determine the law that applies to your respective location. Please ensure that any gaming activity you undertake is within the laws of your respective country. If it becomes apparent to us that you are resident in a country in which the use of the Website is not legal, we shall be entitled immediately to close your account, in which case any balance on the Account on the date of such closure will be refunded to you as soon as it is practicable for us to do so. Due to legal regulations Lucayan Lottery Casino does not accept players from the following territories: United Kingdom, United States of America, France and any EU member state not so far listed above.
PLACING YOUR BET AND/OR GAMING USING THE SERVICES In order to place a bet or access a Service you should follow the instructions provided at the Help tab. It is your responsibility to ensure that the details of any bet, stake or similar transaction placed is accurate and correct. Once a bet has been accepted and placed by you, you will be prohibited rom canceling the transaction unless we agree otherwise express permission. We may, at our discretion (and provided that neither you nor we gain any unfair advantage), elect to accept a bet notwithstanding that the relevant event has begun. In respect of gaming, the relevant Rules tab shall set out our policy for accepting further stakes. We may cancel or amend a Transaction pursuant to the provisions of the terms of use due to verification of your identity, Collusion, Cheating, Fraud and Criminal Activity or Errors or Omissions.
LOTTERY WINNING NUMBERS All 3|4 and 5|6-ball lottery results obtained automatically from official lottery sites and usually published during few minutes after results are publicly available. In some rarely moments lottery result could be obtained manually with a longer delay but anyhow it will match the official results of an appropriate lottery. All 2-ball lottery results are based on last 2 digits of 3-ball lottery results. Lotto Bet games (2-ball) winning results are generated based on results of 3-ball and 4-ball lottery winning numbers. Mixed ball (4-ball) winning numbers are based off the Lotto Bet (above). The player wins if his/her 4 digit bet matches ANY 2 of the Lotto Bet prizes. Fixed odd lotto winning results are shown at Lotto section followed by the sub-section Winning Numbers for 2|3|4-ball lotteries.
REMOTE GAMING OR BETTING When accessing the Gaming Services via an external electronic form of communication you should be aware that In relation to your use of the website for the placing of bets or playing of games: • You may be using a connection or equipment which is slower than such equipment required for the best performance of website; • You may encounter system flaws, faults, errors or service interruption which will be dealt with in accordance Lucayan Lottery IT failure policy; • The Game Rules for each event or game offered via the website are available and should be considered by you prior to your use of the Gaming Services offered via the website; and in relation to your use of the Gaming services, if you are betting on an "running" event, you may not at any relevant time be able to see or otherwise be provided with the most up-to-date information in relation to the relevant event. We shall not be liable to you in respect of any losses suffered or costs incurred by you as a result of any delay in the transmission of information relating to any "running" event.
SPORTSBOOK These rules form an agreement between Lucayan Lottery and Lucayan Lottery members. Registering as a member of Lucayan Lottery will be proof of your acceptance of these terms. Members are fully responsible for ensuring contact and payment details are accurate at all times. Lucayan Lottery accept bets from those members that are 18 years and over, and may ask for proof of age at any point. Members may have their account suspended until such proof is provided. Members must keep their sensitive details confidential at all times. If you believe your details are no longer confidential, you must inform Customer Service immediately, as any account activity is your responsibility. These Terms and Conditions are presented in English. In the case of any ambiguity of these Terms and Conditions in other languages, the English version shall prevail. Multiple accounts are not permitted. We reserve the right to void all bets and close any accounts found to be duplicated. Bets may be placed up to the advertised start time. Any bets placed and accepted after the event start time shall be deemed “not in play”. Bets on different selections within the same event where the outcome of one affects or is affected by another will not be accepted and will be voided in the case of accidental acceptance. 'Bets' will be settled according to the order in which they appear on the betting slip until assigned monies have been used. In the case of these funds being insufficient to complete or continue the bet, the selection in question will be settled according to the amount available. Lucayan Lottery ensures accuracy at all times but occasionally errors do occur. We accept no responsibility for any such errors, and in such cases where results are affected all bets will be voided. We will not be held responsible for any damages or loss resulting from the use of the website or related content including operation or transmission delays or interruptions, loss/corruption of data, line/communication failure, misuse of website or associated content, or any errors/omissions on the website or associated content. Maximum winnings per member per day via this website is $50,000 or currency equivalent. The minimum amount for a bet is $0.10 on any participating game. We may offer lower odds on some bet types than is offered on singles. Members are advised to maintain records of all transactions, game rules, cancellations rules and payment services for future reference. Bets are processed and deemed active once they have been placed and acceptance confirmed. Every effort is made to ensure all information displayed on the website is accurate, but should be used only as a guide. We cannot be held responsible for any errors in event details. Members are advised to consult the Betting Rules for details of bet settlements in such circumstances. Members can place bets as soon as funds have been successfully added to their account. Members accept that we may use first name, account and country of residence of significant winners for advertising purposes. In all other cases, members' details will remain confidential. Bets on events that are subsequently cancelled will be voided and monies refunded. Member offers are limited to one per person, family, address, email, phone number, payment account number and computer, We reserve the right to withdraw offers from any member or group of members. Member account information is deemed as unique regarding your name and personal details, and may only be used by you. It shall not be duplicated under any circumstances. In the case of duplicated accounts, we may close such an account and:
• Void and forfeit all bonuses, free bets and winnings;
• Refund all deposits less voided winnings;
• Reclaim any other funds from any other duplicate accounts.
In the case of bets placed on incorrect prices, bets will still stand but will be settled at the revised price. In the case of members having both a bonus balance and a real money balance, the real money funds will be used first. In cases where the deposit that triggered the bonus, plus any generated winnings, is transferred to casino before fulfilling the 2x rollover requirements, this will be deemed as attempted bonus manipulation, resulting in cancelled bonus and associated winnings. Any bonus manipulation will result in us reclaiming the bonus and any associated winnings from member accounts. These terms and conditions will be updated from time to time and it is the members' responsibility to check regularly for such updates.
COLLUSION, CHEATING, FRAUD AND CRIMINAL ACTIVITY The following practices (or any of them) in relation to the Services:
• abuse of bonuses or other promotions; and/or
• using unfair external factors or influences (commonly known as cheating); and/or
• taking unfair advantage (as defined in paragraph 12.5.3);
• opening any Duplicate Accounts; and/or
• undertaking fraudulent practice or criminal activity as defined above,
• constitute "Prohibited Practices" and are not permitted and will constitute a material breach of the Terms of Use.
We will take all reasonable steps to prevent and detect such practices and to identify the relevant players concerned if they do occur. Subject to the above, however, we will not be liable for any loss or damage, which you may incur as a result of any Prohibited Practices, and any action we take in respect of the same, will be at our sole discretion.
If you suspect a person is engaged in any Prohibited Practice, You shall as soon as reasonably practicable report it to us by e-mailing us or telephoning Customer Services. You agree that you shall not participate in or be connected with any form of Prohibited Practice in connection with your access to or use of the Gaming Services if:
• we have reasonable grounds to believe that You have participated in or have been connected with any form of Prohibited Practice (and the basis of our belief shall include the use by us (and by our gaming partners and our other suppliers) of any fraud, cheating and collusion detection practices which are used in the gambling and gaming industry at the relevant time); or
• You have placed bets and/or played online games with any other online provider of gambling services and are suspected (as a result of such play) of any Prohibited Practice or otherwise improper activity; or
• we become aware that You have "charged back" or denied any of the purchases or deposits that You made to Your Account; or
• You become bankrupt or suffer analogous proceedings anywhere in the world, then, (including in connection with any suspension and/or termination of Your Account) we shall have the right, in respect of Your Account (and/or any other account held by You with a Axum Limited company) to withhold the whole or part of the balance and/or recover from the account the amount of any deposits, pay-outs, bonuses or winnings which have been affected by or are in any way attributable to any of the event(s) contemplated in these terms of use without prejudice to any other rights (including any common law rights) that we may have against you, whether under the Terms of Use or otherwise. "fraudulent practice" means any fraudulent activity engaged in by You or by any person acting on Your behalf or in collusion with You, and shall include, without limitation: (a) fraudulent charge-backs; (b) the use by You or any other person who was participating in the same game as You at any time, of a stolen, cloned or otherwise unauthorised credit or debit card, as a source of funds; (c) the collusion by You with others in order to gain an unfair advantage (including through bonus schemes or similar incentives offered by us); (d) any attempt to register false or misleading account information; (e) any actual or attempted act by You which is reasonably deemed by us to be illegal in any applicable jurisdiction, made in bad faith, or intended to defraud us and/or circumvent any contractual or legal restrictions, regardless of whether such act or attempted act actually causes us any damage or harm; "criminal activity" shall include, without limitation, money laundering and any offence under of the Gambling Act; and "unfair advantage" shall include, without limitation:
